Law 2466 of 2025, which established the Labor Reform, stipulates that starting from July 1, 2025, the compensation for work on Sundays or holidays will increase to 80% of the regular salary, in proportion to the hours worked. This surcharge will gradually increase to 90% starting July 1, 2026, and to 100% on the same day in 2027.
The worker who exceptionally works on a mandatory rest day is entitled to a paid compensatory rest day or a monetary compensation, at their choice, as provided in the previous paragraph.
The worker who regularly works on a mandatory rest day is entitled to a paid compensatory rest day, without prejudice to the monetary compensation.
Se entiende que el trabajo en día de descanso obligatorio es ocasional cuando el trabajador o trabajadora labora hasta 2 días de descanso obligatorio durante el mes calendario. Se entienden que el trabajo en día de descanso es habitual, cuando el trabajador o trabajadora labore 3 o más de estos durante el mes calendario.
Law 2101 of 2021, which established the gradual reduction of the workweek to 42 hours, will apply starting July 15, 2025, as follows
Starting December 15, 2025, the night work schedule will change to the hours between 7:00 PM and 6:00 AM of the following day.
The law maintains a 35% surcharge on the value of the regular hour for night work.
This surcharge will be added in the case of overtime pay.
The employer must maintain a detailed record of overtime hours, including the name, activity, date, and whether they were daytime or nighttime hours.
Overtime hours will be limited to a maximum of 2 hours per day and 12 hours per week, except in the healthcare and security sectors.[i]
